1. Who we are

Tovi is operated by GenesisX Group LLC, a limited liability company registered in Delaware, United States, at 10001 Lewes Road, Wilmington, DE 19709, United States. The lender of your advance is named in the loan documents you sign before any money is sent.

These terms cover the website and the service. Your advance is governed by your loan documents; where they and these terms differ, your loan documents apply.

2. The service

Tovi Early Pay is a short cash advance, sized from your own income and bank activity, that you repay in one payment on your settlement date, usually your next payday. Before you accept, the offer and your loan documents show the amount, the fees, the total you will repay and the settlement date.

3. Who can apply

• You are of legal age (18 or over) and live in the Philippines.
• You apply for yourself, with your own identity document, phone number and accounts held in your own name.
• Everything you tell us is true and complete. We may decline or cancel an application, or stop a payout, if it is not.

4. Applying, offers and decisions

Checking your eligibility does not affect your credit score. We decide whether to make an offer, and for how much, from the information you give us and the bank activity you share. We may decline an application. An offer can expire; the offer page shows when. We verify your identity before any money is sent.

5. Your account

Keep your password, PIN and the codes we text you to yourself. Tell us at once at support@tovicash.com if you think someone else has used your account. Tovi never asks for your password, PIN or a one-time code by email, text or social media message.

6. Repaying

You repay on the settlement date shown in your loan documents and on your account page, using the methods your account page shows. You may repay early at any time; it costs nothing extra. Partial payments are accepted, and whatever remains stays due.

7. Cancellations, returns and refunds

Tovi provides a financial service, not physical goods, so there is nothing to ship back and returns do not apply. Here is what applies instead.

• Before the money is sent. You may withdraw your application or offer at any time before the payout by writing to support@tovicash.com. You owe nothing for an advance that was never paid out; a Tovi Plus month already charged follows the Tovi Plus rule below.
• After the money is sent. The advance cannot be returned for a refund of its fees. You may repay it early at any time, at no extra cost; the fees shown when you accepted do not change if you repay early, and they are not refunded.
• Tovi Plus. If you joined the membership, you can cancel it at any time from your account page, and nothing more is charged. A month already paid is not refunded.
• Paying too much. If you pay more than you owe, or pay twice by mistake, the extra is held as credit on your account. Write to support@tovicash.com and a person will arrange to return it to you.

Nothing in this section takes away any right you have under Philippine consumer protection law.

8. Using the site fairly

Do not apply in someone else's name, upload altered documents, try to get around our checks, or interfere with the site or copy it by automated means. We may close an account or refuse service when we see this, and we may report fraud to the authorities.

9. Your data

How we collect, use, keep and protect your personal data is explained in our privacy notice, our data retention policy and our information security policy.

10. Availability and liability

We work to keep the site available and accurate, but it may sometimes be unavailable, and payouts and repayments also depend on banks and e-wallets outside our control. To the extent the law allows, we are not responsible for losses caused by events outside our reasonable control. Nothing in these terms limits a liability that the law does not allow to be limited.

11. Changes to these terms

We may update these terms. The new version is posted on this page with its date. A change never alters the loan documents of an advance you have already signed.
